Reader Offer Thoughts on the U.S. Supreme Court

Editor,

Recent SCOTUS decisions are very questionable from a legal and ethical perspective.

The makeup of the court is heavily right wing, and definitely not hesitant to show that.

There are major factors which can overcome Supreme Court decisions which are biased, prejudicial, illegal and/or unconstitutional.

-The Supreme Court has zero enforcement capability.

-They can only make decisions which are within Federal jurisdiction, not State jurisdictions.

-Federal law enforcement is carried out by the FBI, and by the Federal Marshals Service.

Both of these report only to the Attorney General, and the Attorney General reports only to the President.

Therefore, a deeply unjust, unpopular or illegal ruling by SCOTUS need not be enforced at all should a president so choose.

(Canada has a “notwithstanding clause” to choose whether or not to enforce court rulings.)
